Extra marital affair and adultery by wife

Hi, my wife has extra marital affair and involved in adultery with her office friend. I have proofs for it like Instagram chats, audio call recordings, call history, gps location, hotel bookings, bank statements, her phone and few photos of both of them. I wanted to check if this proof is sufficient to prove extra marital affair and adultery. Also want to check if courts can grant divorce based on extra marital affair if I am unable to prove adultery in the court.

You may file divorce on the ground of both adultery and cruelty so that if you are not able to prove her adultery, atleast you may be able to prove her mental cruelty and get the divorce. This all depends on the evidentiary value of the proof you have with you.

Well, whatever evidences you have are sufficient for seeking Divorce from your Wife on the ground of Adultery. Still, I need to minutely scrutinize all such evidences, before presenting them before the Court, to seek Divorce for you on the ground of Adultery. If you are unable to prove Adultery, then too, you can get Divorce on the ground of your Wife's Extramarital Affair.

In my opinion the above mentioned chats, recordings etc are definitely enough to prove the guilt of your wife provided clearly indicate her relationship. On the basis of all of your mentioned proofs you can apply for divorce on the grounds of mental cruelty as well as adulterous relationship. The court will consider the presented proofs for granting divorce. It is quite possible that when your wife comes to know about you having knowledge then she herself might get ready to obtain divorce by mutual consent.

yes if you can prove the adultery then the court will grant a divorce
and it's my suggestion to kindly file divorce case as soon as possible
otherwise your wife has the right to sue for maintenance and domestic violence
