Ex Wife Demanding Maintenance after 50 years of Legal divorced
21-Apr-2025 (In Divorce Law)
The maintenance was agreed while legal/official divorced was given in 1975, but it was stopped after 25 years in 2000. bcz elder son took the responsibility of mother maintenance but it was mutual discussed with father, not taken in written. And, now a second Son insisted Mother to give legal notice to father for giving maintenance again and claiming on property. The ex husband age is 80 years and he is pention holder and having second wife responsibility also. ..Need advice on this
From the facts as stated by you, if the ex-husband had stopped paying maintenance to the first wife 25 years ago, and there was no claim thereafter, then it clearly shows that the wife was no longer requiring support from the husband. Feel free to contact me for seeking any legal advice as regards the same.
Dear client based on your question,
Under Section 125 CrPC and Maintenance and Welfare of parents and Senior Citizens Act, 2007 a divorced wife can claim maintenance if she is unable to maintain herself.
Even though the maintenance was stopped by mutual discussion, it does not legally end her right if she is still in need.
