If you have filed a case in court through your lawyer, talk to your lawyer. The other party has received notice of the case and is not present in court through his lawyer or in person, then you can get an order from the court to proceed with the case ex parte. An ex-parte divorce under the Hindu Marriage Act, 1955, occurs when one spouse files for divorce and the other spouse is either not properly served, does not appear in court despite being served, or is intentionally evading the proceedings. In such cases, the court may proceed with the divorce in the absent spouse's absence, resulting in an ex-parte decree.
