Enforcement Of Maintenance Order

I need to enforce payment of arrears further to my interim maintenance order. Is it a pre printed form available at family court or is it a separate Petition?

If the maintenance order is under section 125 crpc, then the procedure to be followed is under 128 crpc for which execution appln is to be filed. If the maintenance is granted under hindu marriage act or DV Act, then also you will have to file a execution application before same court to seek enforcement of the maintenance order.

Hi Good Afternoon, If you got an order for maintainance then go with recovery or execution petition. this petition will file in the family court. this one is the legal remedy available. but besides this their are other legal ways to execution of maintainance in the same case. for more details and querries then contact us and visit our website

In order to enforce Judgement to pay arrears of Interim Maintenance Pay Order, you can request the Family Court Judge to issue arrest warrant against the accused, if he is intentionally not paying maintenance to you to save his money + You can file a Contempt of Court Case against him for disrespecting the order of the concerned Family Court.
