Draft Agreement Regarding MUTUAL CONSENT DIVORCE

We are living separately from last 2 years. We married in 2007 & our daughter was born on 2008. I am staying with my daughter for her up bringing & further education. My wife has a extra marital relationship & she left our house 2 years back. She has filing one false case u/s 498a, which is pending to honorable court. Now my Mrs & I want to separate legally by mutually divorce consent. I want one draft of MCD with the following points to be considered, 1.there will be no claim of any permanent alimony, monthly maintenance, or any property belongs to me. 2. Our daughter will stay with me for her up bringing & further education. Daughters can decide further when she reaches 18 years or more. She is now 11.5 yrs. 3. All pending cases such as u/s 498a, 506 etc will be dismiss by this MC petition. 4. any other important points which have to mention so that there will be no problem faced in future. We are HINDU My age is 46 yrs my wife's age is 36 yrs our daughters age is 11.5 yrs

As per query in law rato if u want to file a case for mutual divorce so jurisdiction if yours is required and also all the clauses which you have mentioned here will be there so you can contact as per the requirement .

hi, in your case i have tell you that generally we mention all those things but then also as you have mentioned if i do the same (just example) i will be providing all those and its quite natural before the final execution all the cases should have to be dismissed or withdrawn, if you need any extra info you can contact me.

i wish whatever you both are doing are so easy, because, 498a cannot be withdrawn, you have to go for quashing and quashing is rare, even if settled, quashing may not happen, Mutual consent divorce is risky. anyway, be very careful and block all loop holes
