Maine mutual consent se divorce file kia..jisme husband ke side se alimony ni diya jarha h..first motion pass ho chuka h..toh kya ab Dv case file kr skti hu?..mjhe inlaws and husband ne ghr se nikal diya ta and last 6 months se alag reh rhi hu..
yes afcourse you can file a case under Domestic Violence Act. as the divorce is not final and there is no settlement. a women has already right to reside in a shared household and many other Relief under the Protection of Women from Domestic Violence Act.
so you can file a case against them.

you both have not settle all the things before file of mutual divorce. if they denied to pay you then you can withdraw your consent from mutual divorce and you can file a suit for alimony or maintenance. also you can file DV case.

You have the right to claim maintenance. However, if you waive this right once, you cannot claim it again later, regardless of the stage of your mutual divorce proceedings. If you have not waived your right to maintenance, you can still file a case for maintenance against your husband.
