Domestic violence done 3 years back

Can close relative person(eye witness) file a DVcase or complain now,regarding harassment done by mother in law and husband family to wife 3 years back.Due to harassment done at that time wife(shifted to job in native) and husband living separate for 3 years. Now husband sent divorce petetion.

Dear Sir, The limitation for filing Domestic Violence case under relevant act is only twelve months from the date of leaving the house of husband/matrimonial house. However, complaint under Section 498A of Indian Penal Code may be lodged.

yes you can file a domestic violence case in the place where you reside and also get all the reliefs, like maintenance, residence order or rent , protection orders etc, further as he has filed a divorce petition you can engage a lawyer and defend the divorce petition and if can also be got transferred to your place where you reside if the divorce case filed by your husband is too far.

That wife cannot file any complaint now but she can file domestic violence case against her husband even now. does not want yours she can treat our she can alimony or maintenance. does she have children ?
