Domestic violence against wife..

I got married around 11 months back and since the beginning my wife has been torturing daily. She got me separated from my family and always runs behing my money. She assaults on me and complaints to her parents that i am doing violence. Her mom is the key player in all these as she guides her daughter to do the quarells and not to cooperate. This is obvious that if we file a mutual divorce the inlaws will file a false case of domestic violence. Please suggest how to get rid of her without loosing money.

You can file a divorce on grounds of cruelty u/s 13 of HM then you may ready to produce cruelty evidence like demanding money or blackmailing on you.there is no chances of domestic violence act when mc case will runing on the besis of cruelty.

Dear sir,
you can file for mutual divorce only after completion of one year of marriage.There is specific remedy in such condition for husbands. and you can't stop your wife or in laws to file domestic violence case against you if they decide. In D.V they can seek only maintenance for wife nothing else . If situation is not under control they start living separately and try for mutual divorce .

Hello,
If you feel your relation is not going peaceful because of your mother in law then I would suggest you to give a try to sit with your wife and discuss about the problems you are facing and find solutions.
In case of failure you can file for mutual consent where both of you are willing to legally separate and get divorce. After filing for mutual consent her mother cannot file for domestic violence against you as she has voluntary consented for divorce.
In case if she refuses for mutual consent divorce then you can file for divorce under the ground of mental cruelty.
But you have to be prepared to give her maintenance in any of the above options if in case she is earning well you can seek for some reduction in the alimony.

As you informed in your problem all amounts to mental crualty and on that basis you can seek divorce. I hope from the above circumstances i can say that no chance of mutual consent will arise in your case. Please ask her for divorce by way of mutual consent. If agreed then it will fine. Other wise you need to contest the case on facts basis.
