Is it necessary to send legal notice before filing divorce petition in family court? Can we file divorce petition on the ground of cruelty due to mental illness on the basis of medical reports or is it mandatory to send the notice first.
no notice is not mandatory part you can file the petition directly in the court but u need to also have proper evidence to prove that you have been subjected to cruelty and also affixing those evidence you can proceed to the directly
