you can charge him of adultery or you can seek divorce from your wife on the ground of adultery .You will immediatly get divorce since you have full proof evidence .Immdiatly file a plaint court will pass order after 6 months and you are also not bound to give any maintenance to her

you can file the suit of adultery against that man ,there is provision under INDIAN PENAL CODE ,under which aggrieved husband could file a suit if any male has sexual relation with his wife .As far as your other question is conserned it will dealt under HINDU MARRIAGE ACT ,for that conclusive proof of evidence has to be produced in the court of law , properly prepare custodian of EVIDENCES which must be conclusive, although there are number of case law but each case is unquie and should be deal as per se .Feel free to put forward any other query ,always Welcome .

Sir,you may move a complaint under section 497 IPC against that person for adultery which is in law punishable upto 7 years. And if you may desire to divorce your wife,it would be a good ground for dissolution of marriage.
