Divorce without travelling to India
07-Oct-2024 (In Divorce Law)
My spouse and I are both NRIs; I'm from Bangalore and she's from Nagpur. We got married in Nagpur, but we've decided to separate amicably, and we don't have any children. We were undergoing IVF treatment, and the clinic has collected my wife's eggs and my semen. How can I inform the clinic not to use my semen to create a child? Since we are getting divorced, what are the legal steps to notify the clinic, and how can we get divorced without coming back to India?
One or both parties can appoint a trusted family member or their lawyer as their Power of Attorney holder to represent them during the court proceedings. This allows either party to be represented without being physically present in India.
For IVF you should convey the situation to the dr in written with consent of both parties. And can ask for destroy the sample of yours.
okay I understand your questions yes it is possible to take divorce without your presence but you have to give GPA for any one your relative like parent it is important and you have to appear through vedio conferance before mediation and before judge some required documents is you shuld arrange.
Dear Sir,
You can immediately get issued a legal notice through advocate to the said clinic not to make use of your Semen to create a child for your wife since there are differences between you and matter being taken to family court. If the clinic did not listen then approach family court file divorce case along interim application and take restraint order against such clinic.
