Divorce within first year of marriage

After our marriage, i cheated on my wife with a friend, i have faced so much mental torture since than been fighting everyday. I asked her to give me divorce but she doesn’t wanna leave me she always blackmail me to file. Case with false charges against me and my parents. Last December we mutually agreed that we will part ways and she asked me for a kid. nnShe is 3 months pregnant and she doesn’t wanna leave me at all. I don’t wanna live with her and I don’t know what to do. She have support from my parents and family because i cheated on her and ahe is pregnant. I don’t wanna do anything with her and the baby. nI am from ncr, nnCan anyone help ?

hello client as i can see your issue i can undersrand the tourture you are under going right now. but as you said you wish to get divorce from your wife. yes you can get divorve from your wife. as well as you need to take precaurionary steps yo safegaurd your self from fake cases as well . but you need to file divorce case before tht we can do anything tht is the first step

Rather than dragging your relationship you should file for divorce against her on cruelty grounds. I would suggest you to go for the mutual divorce after executing a settlement deed because it is less money consuming and ends up in maximum of six months. Whatever is mentioned above is completely going against the concerned husband and he seems to be very uncomfortable in this situation. The husband concerned has remedies available to him and can approach appropriate authority in this regard.

Sec. 14 of the Hindu Marriage Act permits you to file a divorce petition within 1 year of the marriage with the leave of the court but you must showcase that you have been a victim of extreme depravity by your wife. If you have completed one year of your marriage, you can file for divorce.
Since she is not ready to give you divorce, it would not be mutual and easy.
Since you cheated and your wife is 3 months pregnant, there are high chances that if you file for divorce, your wife can file a complaint against you as a result of which you can be arrested.
Hence, before filing for divorce, apply for Anticipatory Bail u/s 438 of Cr.P.C.

But before everything, I would suggest you to have a clear conversation with your wife and communicate to her that you want to leave. Before approaching the court, try to have a mutual understanding regarding everything.
