Divorce with property dispute and separation

Boy booked the under construction property with loan on Sole girl's name.Booking/Advance amount was paid directly by boy to builder bank accountNo money was spend by girl/ girls relative on marriage/engagementnAll jewellary was purchased by boy only.Postmarriage girl stayed for only 2 months together and later she left to parent place.It's more than a year they are living seprately.Today girl is agreeing for divorce but not ready to return the booking amount nor she is ready to transfer the flat to boy name. She is not ready to give jewellary tooPlease tell what are the options for boy.

You can file for recovery of the property on the basis of the amount being paid by you. Also jewelry gifted at the course of the marriage become streedhan and can not be called back. You need to discuss the entire case for better advice. Feel free to contact Thanks

Boy can file case of divorce against girl. Any jewellery, gifts etc. given to girl are her streedhan. girl has complete right over her streedhan However, the boy can recover the flat that he had paid for but was purchased in girls' name. should you have any questions please feel free to contact me

You cannot ask for gifted items and you can’t even forcefully ask her to transfer the Propety In your name. However, you can recover the amount from the girl which you paid to her to the builder and for the same we need to file suit for recovery!

If the parties want a mutual divorce then they will have to agree on all the terms and conditions before they file for the same. however if the girl's side is not agreeing to pay back the booking amount or transfer the flat then the boy may file a contested divorce.
