Divorce with mutual consent living in same house but in separ

We have been married since 1995. Relationship was always sour but worst since 2013. Since then living in same house but different rooms for sake of children. Also daughter suffered from brain stem stroke since 2016. Hence again forced to stay in same house but in different rooms. Now seeking divorce with mutual consent. Can we still file joint petition for divorce with mutual consent?

yes u can filed jointly petition for mutually divorce and also one lawyer and it's finals six months when u file this petition since within six months u got yours divorce if any further proceedings u can come in my office and discuss it

Yes you both can file divorce Petition under the provisions of Hindu Marriage Act. As mentally you are not one and even if you both are residing under same roof you both are not residing emotionally far away from each other.

Yes you can very much file a joint Petition for Divorce by Mutual Consent irrespective whether you are residing under the same roof or not. It has to be mentioned in the Petition that there is no relation of a husband and wife since more than one year inspite of both of you residing under the same roof.
