Divorce settlement with earning wife

29-Sep-2023 (In Divorce Law)
We are married for 20 years and we both earn. My wife had an affair 4 years ago about which I came to know two years ago. She agreed not to see him to continue the marriage, However, after 6 months she was still talking to him. This time she got a legal letter from that person that would not talk to each other. After a year, I came to know they are still talking. I wanted to take divorce but she said I will make it work. It has been a year and she doesn't talk to me, no relationship and few months ago I left her and kids and working outside. Now she wants divorce. I am very frustrated and do not want to give her anything, no maintenance and not even kids education fees (she earns about 50 Lac per annum). Is it possible?

Yes, You can file application for divorce in the court against her. Court can take into consideration her income source cannot allow maintenance to pay her. But you have liability to pay maintenance to your kids

the divorce petition can be filed making base of adultery and for maintenance both parties will have to fill a form disclosing all assets and income details and if husband holds lesser than wife wife will not get maintenance for kids upto the age of eighteen father is responsible but the income of the father will be considered and can get relief at some extent
