Dear Sir, It is a long process unless your spouse agree for Divorce. If the children are in your custody then it is not advisable to seek permanent custody of children. You may seek visitation rights. The latest trend is that the Divorce petitions if contested strongly the ultimate decision may come out after three to four years.

Usually children upto age of 7 years are allowed to remain with their mother even when she is not earning. And even if she is earning well, child's maintenance is to be shared by its father. For a divorce either both should agree on everything or one should have a proper ground to file.
