I would like legal advice on Divorce for my Brother . He wants to initiate Divorce cos his wife has lost feeling for him ...However she doesn't seem to ask for a Divorce and prolonging things.I want to know as per legal stand point what are the consequences if my brother initiate divorce. - his wife is working currently, staying mother place & no children. They hav been married for 4 Years
Your Brother can file a case for contested divorce as per the grounds of divorce given in the personal law applicable to him. As you have mentioned that his wife is also working then depending on her income and your brothers income if at par with each other , he may not require to pay alimony to her.

She can file a contested divorce petition in family court, but the divorce is only granted on certain grounds. Cruelty, desertion and adultery are 3 grounds. Mainly you have to file a petition with your contention and contents. There are no set consequences... each case has its own pros and cons and once the reply shall befiled by the wife one can get an idea about future case.

Dear queriest, as per your query you have mentioned about the fact that your brother wants to initiate for divorce since his wife is not showing any interest in him and hence left the matrimonial home and now you want to take step for your brother by initiating divorce proceedings, here I would suggest that firstly we need go send notice your brother's wife and wait for her reply to the notice if she agrees for mutual consent divorce then we can proceed if she doesn't then we can go for litigation.
