Divorce Proceeding within 10months or earliest

The Husband was working in Bangalore and the Wife was working as a consultant in the US. At the time of wedding, both were Indian citizens. In 2011, the wife became a USA citizen but husband wasnt aware. They had a mutual understanding that the wife would shift to Bangalore but didnt happen and there is a child born out of wedlock.They stayed together for only 20 days a year from 2004 to 2014.After this there has been no communications between them. Based on the facts can divorce within 10month

yes it is possible to get divorce within 10 months, firstly you have seen under which act the marriage has been performed whether under Hindu marriage act or special marriage act and accordingly you have to file the divorce petition before the concerned family court which has jurisdiction, further if both parties are ready a mutual divorce petition can be filed, as there is breakdown of marriage it is possible to get divorce.

Hi , Yes Divorce can be done if both parties mutually agreed upon then it can be expedited but facet is that both are not in contact then you have to send court notice through embassy for the divorce to the wife on the after where she is residing.

Dear Sir, If it is Mutual Divorce there are chances of getting Divorce within 10 months. Since marriage seems to have been happened in India. The party residing in India may file a Divorce Petition on the grounds of voluntary desertion and may get divorce as wife not ready to continue marriage bonds as it lasted for only 20 days.
