Divorce on the ground of mental and physical torture

It's been more than 6 years of our marriage n I have a 5year old girl but my husband started torturing me from very first day of my marriage and I many times he does physical violence against me and remain like a a stranger with me.he talk sweelty only when he wants can't fulfill his physical desires. get divorce from my husband?

Yes you can file for the divorce against your husband on the base of physical and mental torture The Hindu Marriage Act-1955 has given the legal provision for divorce on basis of cruelty under section – 13(1)(ia) as follows;

“Any marriage solemnized, whether before or after the commencement of this Act, may, on a petition presented by either the husband or the wife, be dissolved by a decree of divorce on the ground that the other party has, after the solemnization of the marriage, treated the petitioner with cruelty”.

You can file divorce on the ground of cruelty, but you should have solid grounds to file divorce , to prove the acts of cruelty, it would be better to file maintenance and domestic violence case instead of filing divorce first..

You can file a divorce petition again him under section 13 of Hindu marriage act on the ground of cruelty. You should also file a criminal complaint against your husband under section 498(a) for cruelty.

It depends how many times you had reported the domestic violence to the police or authorities well you should always report and then it will matter if you have medical reports to support your statements so rest is legal job the chances are you will get divorce

Yes u can take a divorce from your husband.first u file a a divorce case before district court and the plea of cruelty .u can claim also maintance from ur husband for u and ur daughter...
