with reference to your query if there is a court order running against your husband to provide maintenance to the child and you and in the event he intentionally does not makes the payment of maintenance amount, you can very well approach the court for divorce. regards

Hi Good Afternoon, In your case wife separated from husband on her own will. but she was not judicially separated So she can file the Divorce. and their are multiple grounds to file Divorce and she has a right to file. but if she want maintainance for children then she can claim maintainance from various legal cases. and she can claim maintainance for herself also. as per the law its husband responsibility to maintain wife mental, physical and financial. but off course you have also multiple legal remedies to defend yourself. and their are various high court and supreme court judgement which are in the favor of husband. for more querries and details then contact us and visit our website

Wife and husband have relief of divorce under the different statues in India. Depends on the facts and circumstances. If there is any case pending for maintenance and there is a default or something on the part of husband or else: need more details
