Divorce on fast track-without mutual consent
21-Aug-2023 (In Divorce Law)
Hi Sir
The Divorce case was filed in Bangalore Family court last year in November. (its not mutual)
She didnt appear even for a single hearing.
Court has ordered to issue hand summons (on 31st July 2019) which is yet be delivered to her. Now the next hearing is scheduled to 4th November. Are there any chances to fast track the case and get the judgement ASAP (before November) or to prepone the hearing in the next month. Kindly suggest if there is any possibility to get the issue solved on fast track.
Thank You Sir.
Regards
Prashant
yes it can be done by filing an application in court and advance the case, further as hands summons is given you have to get it served on your wife, if she appears then there will be conciliation and if conciliation fails the case will proceed as per law, if after receiving summons if she does not appear then you can lead evidence and get an ex parte divorce decree.
you have a file an application in court to advance the case and get the date changed to earlier date and also also get the date changed on the summons issued for delivery after which the case will be taken early and you will be in position to decide, if she appears she can file objection or she can get it compromised, if she has no mind to compromise then you have to fight it legally and get divorce. if she does not appear then she will be placed ex parte and you will get the divorce.
