Divorce Notice by Mutual Consent

Marriage was thru Court as well as in Church, but due to some disagreement between husband and wife they are staying apart from each other. Married sine one year 01 year 4 months since date of Court Marriage and 11 months after Church Marriage. Total time spent together after marriage 15 days maximum. Wife unwilling to stay at husbands residence. Husband working abroad.

need to see all the documents. further need to know from how long you not living together though the marriage perform as per church and court. Need to see marriage certificate if it is their.

under Indian divorce act the period of separation should be two years for mutual consent divorce
still you can apply for the same and obtain special leave of the court for the relief
if your marriage is registered under special marriage act then you can proceed immediately
