Divorce not got from first marriage but making false promise to marry

Am a divorcee from bangalore. in 2014 a person promised me of marriage telling that he is expecting his divorce any moment. He and his mother came and met my parents also and promised them also. After 1 1/2 years i came to know that he has not even filed divorce and is living with her. When i fought he applied for divorce in jan 2017. But his wife is staying at his house only. He takes full care of her also and he doesnt want to leave me also. but that divorce case is still going on Now she has come to know about our relationship. But still she doesnt want to leave him. Of late i have a feeling that he is misleading both of us. It is been four years of relationship and now am being tortured by her also and no support from him. I dont know what to do. Can u kindly advice

First its adultery by the person whom you have the relationship now, as he is married and not divorce. You may lodge a complaint in the police station for cheating, misleading and missguiding, breach of trust.

Madam,

Till he obtain divorce you cant marry him in any manner and if you do so the marriage become null and void. From the facts of the case itself i can say that you cant expect of Divorce of him because as your told her wife is not ready to leave him in any manner. Some thing it seems misleading.

Taking care of his wife is his matrimonial obligation and it is his duty until he legally separated from her. In your problem you only informed that himself and his wife is living in a same house. Here you should know for filing divorce case there should be minimum one year separation. I hope it is not so in this issue.

You need to wait till the order of divorce is passed. Until that you don't have any option.

Dear Madam,
as per hindu Law 2nd marriage without obtaining divorce from the competent court is null and void, if your husband married you by suppressing his divorce issue, you can file a case against your husband for cheating but in the interest of save your marriage before filing case it is better to discuss with your husband.
