Divorce my wife in India, I did not sleep with her as she rejected

I have been married over 2 years only had spend 7 days with wife and there was no sex as she refused. I respected her wishes. I do not get on with wife and feel she just wants to come abroad and have me properties. Can she still get anything if she in India and I file for divorce

No Your marriage hasnot been consummated. She will get only what her parents has spend on your marriage. Denial of sex is mental cruelty. Its a ground for divorce and moreover she has desserted you, 2 yeara back henceforth, you can also file for divorce on the basis of dessertion.

We need more facts on this ? Where did you guys get married ? What kind of properties are u talking about ? Your wife can file cases of domestic violence, Maintainence, 498a, etc Kindly b in touch to understand the legalities

Hello, You may file divorce on ground of dissertion/ mental cruelty in India. Secondly, the law of the country you are residing will also play a role in answering your question at length. A wife is not legally entitled to her husband's self acquired property and can only enjoy her husband's self acquired property till her husband's death. A wife cannot claim her husband's property before or after divorce. At most, a wife can only claim money for her maintenance or alimony. should you have any queries please feel free to contact me

Hi In case your wife filed maintenance under section 125 CrPC, you will have to appear before Indian courts to litigate the matter and attend the hearings. The best way forward would be to get separated by divorce by mutual consent.
