You may seek a second Opinion by taking a detailed legal consultation FOR your ongoing matrimonial litigations. Section 9 Petition you may peruse. Since your wife forcefully entered the home and taken valuables, you should file an intimation application before the concerned police station. 498 A case we need to legally peruse for advising the further course of action. This action on the part of your wife in fact strengthens your divorce case. also if she is resorting to such activities as mentioned by you in your query, you may initiate police action against her as well by filing a criminal complaint.

Section 420 IPC won't apply in this scenario. However, brace yourself for a long and expensive legal battle with the divorce proceedings likely to drag on for at least 5 years. During this time, she can demand maintenance from you under section 25 of the HMA, DV act and 125 Cr.P.C., and ultimately, the judge will also grant her permanent alimony, resulting in substantial financial obligations on your part. Considering your options, I strongly advise pursuing a proactive approach. Firstly, you can petition the court to refer your case to mediation, aiming to reach a mutually acceptable resolution for a divorce settlement. This might take 4-5 mediation sessions but its worth it. Alternatively, you should consider taking legal action by filing complaint cases or suits for damages under section 200 Cr.P.C. against your wife and her family members. This will exert pressure on them and potentially level the playing field in your favor.
