divorce from registry marriage.

A friend of mine have a registry marriage and social marriage will have on next year. currently they stay at their own house. Now my friend wanted to comes out fro the marriage. Is it possible to void the marriage ? I dod not the information, whether there registry marriage under special or hindu marriage act.

It is under special marriage act and hence both your friends have to undergo the process of mutual divorce without which either of the persons cannot come out of the wedlock and for the same a divorce decree needs to be passed by the Hon'ble Court

Yes and only process I'd divorce. Ask your friend to file a divorce petition. If both the parties are agreeing then mutually divorce will happen and if not then contesting will happen.

But if duration of marriage is less a year then either your friend can wait to complete the year or go for annulment of marriage. Annulment of marriage will give your friends a opportunity to get separated without being tagged divorcee.

Registration if done before any social marriage happened or if no rituals or customs have been followed then it is special marriage.
