Divorce from Norwegian citizen

27-Jan-2023 (In Divorce Law)
I hold Indian citizenship whereas my husband is a Norwegian citizen. Our marriage was solemnised in India but it is registered in Norway as well. I have been living in Norway for 3 years now I also have a job so I am staying here on job visa. We decided to separate by mutual consent and applied for separation in Norway. We got separation with effect from 26.09.2016 and after 1 year we can file for divorce in Norway and the divorce will be granted without any problem. My ques.1) Does any of us require to apply for divorce in India or we can get divorced in India just by getting the divorce certificate from Norway approved in India? 2) What is the method of getting approved an abroad divorce in India? 3) Can anyone from my husband's family (he himself or any of his family members - none of them holds an Indian citizenship) file any kind of case (deceiving, threatening etc.) against me in an Indian court of law to torture me &/or to delay the divorce proceeding in Norway or in India?

This depends on how you got married in India and under which law. This can be seen from your marriage certificate. Depending upon which law, u may have to file a short proceeding in India to have your divorce recognised. If u plan to stay in Norway then cost benefit analysis also needed if getting divorce recognised. It is not possible to give a full opinion based on the information provided and a detailed discussion would be required.

You need a detailed explanation on this please contact a lawyer directly rather asking at public forum It’s better for you to take a mutual divorce in India as ur marriage was done in India under Special Marriage Act else u will have to get proceedings done in India also u can discuss in detail with me if required

Once you've obtained divorce from Norway, you'll have to get it ratified by Indian Courts. The process doesn't involve a whole new divorce proceeding but a petition will have to be presented before the High Court of the respective State to get the Decree of Divorce from Norway Court registered and valid in India. Yes, your husband can file cases for the purpose of harassment and that's why your rights need to be safeguarded by brining it down to an agreement between you and your husband. You can call me for further clarification on this. Regards
