divorce from drunkard non working husband in hindu religion

My name is Monica. I was married in 2002. I have 2 children, a girl and a boy. My husband drinks too much alcohol since 2011. he doesn't do any work for our livelihood. they drink daily and beaten us abusing us. he is unable to fullfil his responsibility. My life is compeletly hell. Now i decided to get divorce from my husband. the house in which we live is in my name. but it was purchase by him. he always argued and demaded the house paper. I want to know how do i get divorce from my husband. my kids ages are 17 years (girl) and 14 years (boy). Will my children share in their grandparents' property after divorce or not? They live in the village and there is no partition of the property so far. i dont want any alomony or property but i want only future security for my children,

as i can see tht your issue is very much important for an individual to live life cool and happy if the life is becoming hell due to family teasons then it is the worst condition. yes divorce is possible from your husband but it need to be going contested instead of the consented. in my view if you want to get your childreans future safe in tht condition yoi nèed to move in a manner tht your i laws get ready to give share if the property by themself to your childrens to get there future secured. yes your childreans have full rights in there grand parents property you are wrong tht you don not want alimony you should ask for alimony as well because in cases if divorce so much of negotiations take place so its mandatory for to move as per legal remedies avialiable then only it will be possible for tou to get your childreans future full secured .

Hello ma’am. I have perused your query. You can always apply for divorce on the grounds of cruelty and also seek physical custody of your children. As long as the house is in your name you cannot be removed from the same. Further, as far as your childrens’ share is concerned, regardless of the divorce they will be entitled to equal shares in ancestral property.

Ma’am this is a case of domestic violence and first we need to move for that along with maintenance. Subsequently we have to file a divorce petition for separation. Yes your children reserves right in ancestral property. Also the partition proceeding shall be initiated accordingly.
