Divorce from Denmark for Indian couple

Hi nWe are current based out of Denamrk and we both would like to end marriage nHow will we to proceed with filing divorce while continuing to stay in denmark

You can proceed to file divorce by mutual consent if u are hindu under section 13B of Hindu marriage act . U can execute of deed of power of attorney in favour of any family member to file a petition in the court in India ,petition can be filled where u were married or where u last resided together. However for recording the statements it can be recorded by virtual mode. Contact me for further discussion.

if you want to file mutual divorce then the divorce petition can be drafted and filed before the court, but you have to come down to India at least once after 6 months of filing of the case to conclude the proceeding. it is not possible that without your presence case can be completed

yes you can do that in your Denmark or any other country you live with it's a normal process you can consult a local advocate or lawyer regarding this matter and he will definitely help you to sort it out

first one should have the nationality of the country where one is seeking divorce. for example if one of the spouse is Indian national then divorce can be filed in India. second is to see how was wedding solemnized if it was performed through Hindu rituals (Saptapadi) then Hindu marriage act will be applied if it was in Muslim rituals then that law and so on.
