first one should have the nationality of the country where one is seeking divorce. for example if one of the spouse is Indian national then divorce can be filed in India. second is to see how was wedding solemnized if it was performed through Hindu rituals (Saptapadi) then Hindu marriage act will be applied if it was in Muslim rituals then that law and so on.
