Divorce filed by husband on ground of cruelty and he is involved in he

If a husband files divorce on grounds of cruelty saying there is non consumation of marraige in 12 years of marraige. Is this valid. We dnt have kids but he is involved in extra marital affair and has filed divorce saying there is non consumation of marraige. How can I defend this ? Its 12 years of marraige so obviously he is lying.

hello mam as your case is concerned is offcourse not an easy thing to prove by your side. but in this type of cases things are there due which tenchnically things will go in your fevour and you husband can take privillage of the things he is trying claim.

Promiscuous and sullied persons don't get anything in life let alone divorce. if there is non consumation for a continuous period of 12 years, then he has over stayed with you dear. this alone is sufficient to demerit his case. and obviously, there are other good tricks to defend the case. this is going to be very tricky case in evidence. hang in there.

Hello, I have perused your query. In the present case you can take a plea of adultery. However, the same is no longer an offence/ crime but it still is a ground for divorce. If in case you would be able to prime face establish that your husband is lying in his pleadings you then you have an option of moving an application under section 340 crpc and therfore a complaint can be made in this regard. for any further assistance feel free to reach out to us.
