Divorce due to wife being cruel towards mother
28-Sep-2023 (In Divorce Law)
I am a Hindu, married for 5 years with a 3.5 year old son. I want separation from my wife as she is very cruel towards my mother. My mother has single handidly raised me since my birth. She is suffering from severe depression from last many years. My wife prohibits me from helping my mother and my unmarried sister. My mother and sister are very scared of her short tempered behaviour

You can file a petition for divorce to get rid of your wife under Section 13 of the Hindu Marriage Act which provides for divorce on the grounds including cruelty. The word "cruelty" is not defined in clear terms under the Hindu Marriage Act, rather it has to be seen by the Court in the facts and circumstances of each case and in the background of the family from which the petitioner and respondent belong. The summery you made in the query falls within the purview of "Cruelty" and a decree of divorce can be obtained.
