Divorce case pending since 4.5 years, judge changed, no date given

1- Marriage in 1996, Son born in 2000. 2- Filed 498 petition against me and family members in 2004. Same time I got visa to US and flew down to US. No arrest of any one happened. only Search warrants were issue against me. Finally she withdrew the application in 2008. 3-Filed 498 a again in 2008 when I visited India after my Father passed away. This petition was dismissed by police. Later on it was protested in court and court also dismissed it in 2016. 4-Filed for divorce on ground of cruelty and desertion 2010. It was dismissed in year 2013 . 5- Filed in high court in May 2013. Still pending there. Mediation was tried but failed then CM for pray for actual date of argument was made in Nov 2016. 6-Service was completed and final date of argument was fixed to 10 July 2017. No hearing happened on this date as there was oath ceremony of newly appointed judges. 7-Judge was about to retire and case was assigned to different judge. 8-Since then nothing happened and no date

File an application for early actual date again. Stating the grounds of harassment and the fact that a similar application had been allowed previously however due to un-avoidable the same could not be heard.

In fact when a case goes to regular bench in Hon'ble High Court, a regular No. is assigned to same and each time once or twice a year, regular list is prepared again and new No. is assigned to such pending regular cases. So your case may probably have been assigned as per July list of regular cases and from your case no. it can be checked and mentioning can be made to concerned Bench.

Confirm with the court reader the matter would have been fixed for another date, even after final argument the judge might take two three dates of adjournment to pass the final order and this is quite a common scenario
