Divorce case against wife on the ground of adultery

My wife is having extra marital affair with my brother in law and i have a proof for that wherein she has sent nude photographs on to his mobile through watsapp. She also confessed that she has send those photographs but not having such extra marital affair (video recording also there), now sir/ma’am how can i believe her. I just want to take divorce because i now no more trust her and marriage just took place last year in 2016 Nov and we are not having any kids.Also she is putting false allegation on me and my family of DV and Dowry. Also my brother in law has left my sister alongwith two kids and mov to his village and not maintaining my sister and two kids, presently i am maintaining my sister and two kids Can i file case on ground of cruelty and adultery against my wife, also when i told her to divorce on mutual consent she and her family are threatening us continously that they will file case against is on DV and Dowry Act , also she is not ready for mutual consent divorce ?

See for this you hv to prove it by evidences
if u hv proofs over it
there is no such difficulty
to get rid of this relationship

Ofcourse there is a ground of divorce vide those photographs and also the fact that your wife is into an extra marital affair with your brother in law and henceforth you should apply for divorce first and

My sympathy is with u in such difficult time which u r going through, yes u can file a case to seek divorce from ur wife on ground of adultery n cruelty. As u r saying u have video recording n other evidences to prove that ur wife has been into extra maritial relationship with ur brother in law we have a strong case to seek divorce

You can file a divorce petition under Hindu marriage law. There is a Supreme Court ruling that a man cannot be arrested only on the case filed by wife of dowry and domestic violence. You must not continue this marriage anymore.

you should file a case against her and also your brother in law. If you have proof then she will not be entitled to any maintenance and on the other hand lets not forget your sister and her kids are also victims here and they have a right to get maintenance
