Divorce because of domestic abuse

14-Jul-2023 (In Divorce Law)
I want to get a mutual divorce from my husband. He has been physically abusive to me and my daughter since the beginning of marriage and he is an addict. But he will not let me move out easily. What should my next step be before moving or after moving out? What should I do if he forces me to stay? What measures should I take after moving out so he doesn't bother me and my daughter?

Hello Madam, For getting mutual divorce from your spouse even he/she should agree to the terms & conditions of the divorce only then it can be granted otherwise it will be contested. Please chalk out your terms to be laid before your spouse for hassle free mutual divorce. Please call for further clarification on the same Thanks Adv Dr Preeti

Well, you can lodge an FIR and a case against him under the domestic violence act, furthermore you can get the compensation for the wrongs he has committed against you. Consequently, you can file for maintenance as your right under section - 125 crpc, you have right to resort to file a divorce case in 13(b) of the Hindu marriage act.
