I want legal advice on the following points: What is the legal process for divorce in India and how long can it take? If either of the husband and wife files a petition for divorce, then the first condition is that one year should have passed since the marriage of both of them, only then they can prepare the petition and various grounds for divorce have been given in the petition, inclNeither of the husband or wife can live in a living relationship with another man or woman without obtaining divorce. For this, divorce is necessary, only then he can live in living relationshipuding cruelty and demand of dowry

Entering into a live-in relationship before the divorce is finalized is legally risky. Since the marriage still subsists, it may: Be used as evidence of adultery by the spouse Adversely affect maintenance/alimony claims Complicate the divorce proceedings

I understand that you are going through a difficult phase in your marriage, and it is important to approach this situation with clarity and proper legal awareness. In India, divorce can generally be filed either as a mutual consent divorce or a contested divorce. Mutual consent divorce is usually quicker, where both spouses agree to end the marriage, and it may take around 6 months to 18 months depending on court procedures. A contested divorce, where one party disagrees, can take several years depending on the complexity of the case. Regarding live-in relationships after separation but before the divorce is finalized, it can create legal complications. Although live-in relationships are not illegal in India, if you are still legally married, your spouse may raise allegations such as adultery or misconduct, which could negatively impact divorce proceedings, alimony, or child custody decisions. Therefore, it is generally advisable to avoid entering into a new relationship until the divorce is legally finalized. Before filing for divorce, you should take certain precautions. These include gathering all important financial documents, evidence related to marital issues (if relevant), and understanding your rights regarding property, maintenance, and custody. It is also advisable to consult a qualified family lawyer to assess your specific situation and plan your legal strategy carefully. Taking informed and cautious steps at this stage can help protect your legal rights and ensure a smoother process.
