I want to get legally separated from my husband but he is denying to take any kind of responsibility of me or my children and not willing to pay any maintenance. He is a govt officer . Could you please guide what can I do to get this sorted
Hello,
This is Advocate Somdipta Dutta Choudhury.
I am very sorry to hear about your present situation.
You can file a divorce suit against your husband as well as you can create pressure on him by filing a maintenance case and in that process dragging him to the court on each date. You as well as your children have all the right to claim & receive maintenance from your husband.
For more information you can call me.
Madam, you have to file 2 cases. One case for divorce to get separated. The second case is for maintenance. Even if your husband is not willing to pay maintenance under court order he is bound to pay maintenance or go to jail. I suggest you to file the 2 cases for maintenance and divorce. Please call for more details.
