Divorce: 6yr Arranged US/India

30-Mar-2026 (In Divorce Law)
I've been married for 6 years, but for the last 3, my wife and I have lived more like roommates. After a long period of trying to bridge the gap with zero success, I stopped initiating intimacy 4 months ago. I’ve realized I can’t sustain a marriage that lacks a physical connection. Since we were married in India but live in the US, I’m looking for guidance on how to bring this up to her and how to start the legal process amicably.

LEGAL ADVICE Your situation reflects a breakdown of marital relationship, which can constitute mental cruelty if the lack of intimacy is persistent and affects the very foundation of marriage. 1. First Step – Amicable Approach: Initiate a calm and clear discussion with your spouse expressing that the marriage is no longer workable. Propose Mutual Consent Divorce (MCD) as the most dignified and efficient route. 2. Jurisdiction: Since the marriage was solemnized in India, you have the option to: File for divorce in India (if jurisdictional conditions are met), or Proceed in the USA, subject to local laws. ⚖️ Ensure that any foreign decree is legally valid and recognizable in India to avoid future complications. 3. Mutual Consent Divorce: If both parties agree, MCD is the fastest and least contentious method. Terms relating to alimony, assets, and any other rights must be clearly settled. 4. If No Consent: You may initiate contested divorce on grounds of mental cruelty, citing prolonged denial of marital relationship and irretrievable breakdown. ⚖️ Conclusion: Adopt an amicable approach first, but be legally prepared. Proper structuring at the initial stage will avoid prolonged litigation and enforceability issues across jurisdictions. Proceed with clarity and legal caution.

If you are clearly looking to wind up this marriage then consult an advocate, explain to him and move further. by filing a case you need to attend for conciliation if needed, better opt for mutual divorce by discussing as it is speedy process.
