13-Mar-2025 (In Divorce Law)
Hi, I am an NRI and going through matrimonal dispute with my wife. She filed 498a FIR on me and my parents. I was out of India but my parents visited the police station twice. After 8 months while I was waiting for chargesheet to filed, I noticed that she had withdrawn the complain in court.(per court records). Can my parents file defamation case against her based on this?

Yes they can file a defamation case against your wife any time in the court and can claim compensation from her for the mental and physical harassement caused to them because of your wife and she will be held liable for the same in the court

Defamation case won't be the viable option, I would suggest to go for damages for wrongful prosecution. Please reach out to me so that I can review the facts of your case thoroughly. I need to understand the details before providing any further comments or suggestions. I will require more clarity on your situation.

Since your wife withdrew the 498A complaint, it indicates that the allegations were either false or lacked sufficient evidence. Your parents have the right to pursue a defamation case under Section 500 IPC if they can prove that the false allegations harmed their reputation. However, some key legal points need consideration: Grounds for Defamation Case: Public Harm to Reputation: If your parents faced social stigma, loss of reputation, or mental distress due to the false FIR, it strengthens the case. False Allegations in Writing: If the FIR copy, police records, or court documents confirm false accusations, these serve as strong evidence. Malicious Intent: If she knowingly misused Section 498A IPC to harass or threaten, this supports the claim. Legal Actions Your Parents Can Take: File a Criminal Defamation Case (Sec 499 & 500 IPC). Seek Compensation through a Civil Defamation Suit. File a Petition for Malicious Prosecution & Mental Harassment. Since 498A cases are non-compoundable, an official withdrawal suggests either a compromise or lack of evidence. Before filing, consult a lawyer to assess the feasibility of your case.
