Dear Sir/Madam,nI am married on October 2021 and have 1 Girl child, My wife don't cooperate with me for anything, She always complain to her mother and listen what her mother says, She don't respect me and our family, She is money minded when i spend money on her family then she will be happy but when i control it then she will create something wrong.Now she is in her mother home, When i try to call her to check Kid's health she don't respond.Her mother always says that we will clear this in station she don't teach her daughter to stay calm. nPlease provide me any suggestions regarding this. I need my kid back by giving divorce to my wife without any compensation.

I understand your questions so now you want to decide to take a dovorce becouse of your wife arogent nature right she is not expect any claimmfor you right. yes it is possible to not give a maintainance to your wife wnen can your wife working it is not give the maintaimance but you have a child right may be she is asking a child maintainance . so do you need any legal help contact me thank you

sir you have to file a petition for divorce on ground of cruelty and further prove that without any reasonable cause she has left you and residing in her parental house, further under section 26 of Hindu marriage act in divorce petition you can claim for custody of child, initially visiting rights in respect of child will be granted, as the child is below 5 years it is normall given to mother still if you want to get it you have to prove some extraordinary circumstances showing that the mother is incapable of taking care of child, the court will decide about the custody of child looking to the welfare of child and give custody to parent who can give better care, protection and provide a good atmosphere and better future.

you need to have some proof of the behaviour of your wife with you call as non cooperation, and also of the money that you have paid to her family upon their demands. you can file for divorce if you have some evidence of the above. As far as custody of the child is concerned since it is girl child preference will be given to mother up to certain age of the child.
