Dear Sir/ Madam, my wife has left me for 2years telling that she is persuing PG. After her coming she always used to move out to meet someone. Once I have seen her roaming with a person very closely. I gave her a chance not to repeat the same. But she didn't stopped later once again I seen her with same person then we decided to talk to parents. After that she didn't joined me and filed 498A and Maintenance case against me and harassing me. Now I came to know that she didn't do any PG which I said earlier. But she cheated me saying that she is doing PG. Luckily I was having fake PG certificate shown by her when I asked. During cross examination she accepted she done PG on regular basis and attended college. I filed RTI and found it's fake certificate. Can I file divorce petition under this grounds as she cheated me and stayed with some other person for 2years.

Dear Sir It is strong legal ground on the basis of which you can get divorce immediately without alimony. Never give notice to her since there are chances to improve her defences. You may also file 482 CrPC petition to quash pending criminal cases.

You can file divorce petition for fraud and for filing false 498A case... Filing of frivolous petition against husband can be ground for divorce before filing suit first send legal notice and contest maintenance case since if according to her she's post graduate she is not entitled to maintenence

yes, you can file divorce case against her. what are the grounds stated by you will be sufficient to apply for the divorce in the court. For more details contact me. Desertion by the wife without proper reason is also one of the ground to apply for divorce. And If she have illegal contract with anyone person. that is also one of the ground to apply for divorce.
