Contested divorce: husband not ready for divorce

25-Jul-2023 (In Divorce Law)
My friend completed her registry marriage 2 yrs ago but there was no social marriage. They were living separately for these 2 yrs and never stayed together. Now she wants to get out of the marriage as her husband didn't accept her for so long besides she is also having an extra martial affair since few days. But her husband is not ready to give divorce.. What can be done now.. Kindly guide us regarding this matter. She doesn't want any alimony. There is no child or division of assets.

your friend must first send her husband a legal notice seeking for divorce and asking her husband to reply within a stipulated time to reply failing which your friend will reserve her rights to file contested divorce for which your friend shall not be held liable for the consequences. your friend must mandatorily send legal notice before filing any sort of case

1). you did not specified under which marriage act her marriage was solmenized.
2). since they both are living separately from each other for more than a year, in this situation she can file divorce on the ground of cruelty and desertion. She will definitely get divorce through court.
