Contested Divorce from an abusive husband

I got married last year through an arranged marriage. My husband had cheated us regarding his earnings etc. Actually he does not earn anything. To make the matter worse his behaviour is not good and he abused me both verbally and physically in first month of marriage itself. Thats why I am not staying with him anymore for last one year. I want to get divorce but he will not let me.. Pl help what to do? My parents are also dependent on me and Only I can support them. My earning is only 30,000/- per month.

You must file for a contested divorce as soon as possible. As part of the divorce proceeding formalities, you will be allotted Rs. ten thousand p.m. maintenance which your husband will be bound to pay. Along with that we can claim for heavy alimony and maintenance. Further and better particulars are needed for an effective opinion.

I have perused your query and would advise you to file a divorce petition on the ground of cruelty under section 13 of the HMA. Would further advise you to file an application under 24 HMA for seeking maintenance pendente lite. Further you may contact us for legal services.

you are eligible to get divorce from your husband even if he doesnt want it. there are provisions under the marriage laws in India which provide for the same. concurrently, you can even file criminal cases against him if there was an instance of physical or mental abuse
