Conditional anticipatory bail in 498A case

We have obtained ABA from Kolkata high court on conditions of monthly appearance in police station and 75000 Rs as maintenance to my sons wife . Once the chargesheet is filed, do we still need to register our monthly appearance at police station and pay the maintainance amount ?

I am surprised as to how the court can direct you to pay maintenance as a condition in grant of ABA . you may challenge that condition in the higher court. After filing of chargesheet, appearance at the police station is not necessary and it must have mentioned in the ABA order .

you can find an application in the court for relaxation of the condition attending the police station every month . Once the chart sheet is filed in the court there may be no need of attending the concerned police station. however conditions of the High Court must be strictly complied with.

Well, before giving you any legal advice, I need to scrutinize the Bail Order for legally analysing it, so that, proper concrete advice can be given to you. From whatever facts you have stated, it seems that, you have to comply with the Bail Order, if it contains conditions like to pay monthly maintenance to Son's Wife and to keep appearing before the concerned Police Station.
