Marriage is a sacrament between the spouses. You can file a case of Cruelty and cheating against ykur husband/ in laws. However my opinion is to try and reconcile he dispute with the elders from both sides and settle the matter amicably and peacefully...

Madam, If you have completed one year of marriage, you can file divorce petition against your husband. However, before filing divorce petition from your side, consult your husband for mutual consent divorce as he also does not want to live with you. If he accepts for mutual consent divorce, claim permanent alimony for yourself and your kid and file the mutual consent divorce petition jointly. The divorce will be over in six months. However, your husband is not wiling for mutual consent divorce, file contested divorce petition in the family court of jurisdiction for divorce.
