Child Custody of a six year old child

21-Jun-2024 (In Divorce Law)
Can custody of male child who is 6 years of age given to father if the mother is involved in adultery. Does the court not have the right to give custody to father or does this depend on child's decision when he turns to 7 years. This is a case where the father had approached the court in G&WA case.

1. the father has the legal right to take the child into his custody when the mother is living in adultery. 2. you have the right to take the child not on child opinion, but in the grounds. 3 . in gnwc case the father is the custodian and takes the child into your custody even at the age of 7years

To get the child custody on the ground of mother involved in adulatory you need to have sufficient valid proff and you should establish it. Then you seek for child custody on the ground of effect of bad upbringing on innocent mind.

Dear Sir, If wife is in adultery you can permanent child custody and also divorce without alimony. The opinion of child is weighed only 20 percent. Most probably you can get child custody if you have established adultery proof
