Child custody and divorce petition

Wife has been living separately with kids ,she deserted and went to her parents home where kids were staying . She doesn't respond to any msgs / chats . I have had enough of her cruelty I have decided to file divorce . So is it better to file separate case for kids visitation / custody under guardian and wards act or is it sufficient to ask within divorce petition which is going to be contested . Under which can I get relief urgently to get interim visitation rights

In the said situation it is better for you to first file a case for custody of children and ask for at least joint custody and meanwhile ask for visitation rights and wait for filing divorce petition after going through what defences she takes in custody case.

Hello, if your wife has been deserted you more than one year and she staying with the kid In his in her parents house and she is not allowing you to visit your child and you have decided to go for divorce, and it is always advisable to file an application in that case only for the visitation right of Child. Then you can file separate child custody case for the custody of your child later it will Expedia process of visitation right.

Dear Sir, You have to file two separate case one for divorce and one for Child Custody with registration rights. you may get easily divorce on the basis of desertion and cruelty, if she did not turn up to the court. If possible try to get mutual divorce which includes terms and conditions about the registration rights towards children.
