Changing Lawyer and Refiling Divorce Case in Another state

12-Jan-2025 (In Divorce Law)
I have applied for a divorce, but my lawyer has not responded to our calls or messages for the past three months. What is the process for changing my lawyer? Can I withdraw the case and refile it in another state, specifically in my hometown?

Dear Sir, Order 3 of Civil Procedure Code gives aggrieved persons the right to choose one’s pleader. Therefore changing of pleader with the leave of the Court is possible. The new pleader should submit a duly signed Vakalathnama to the court. Hence it is possible to change one’s pleader. In a few cases problem arises with the case history. If the pleader fails to give it to the client, the client can apply for the order sheet by an application to the Court.

You check with the Court file whether the court notice has reached your spouse. if notice has reached your spouse it is easier to continue the case at the same place. otherwise you can withdraw the case in present court and file from your hometown.
