CAW complaint- No settlement chances (High Amount)- Expecting FIR

21-Oct-2023 (In Divorce Law)
Working Wife n kid staying away since 1.5yr. False Complaint in CAW cell for Dowry and harassment, and asking exorbitant amount to settle otherwise threatening to file cases. Question: 1. Should I send some monthly child care from now on, does it help (to reduce maintenance) later on when cases are filled. (I know she doesn’t need it as wife working and wealthy family). 2. Also how to negotiate for a reasonable amount in CAW to avoid cases and harassment.

Sir first of all you need to file a NCR against your wife then you can move for annulment of marriage as per Hindu Marriage Act. That morever you can approach to high court for quashing of complaint against your wife.

See if your wife is working and has a good income , she will not be entitled to maintenance. Considering her expenses and your standard of living some nominal amount can be granted. Since you Have an apprehension that She might implead You in false cases its better to seek a detailed legal consultation and formulate a strategy going forward.

If the behaviour of your partner is intolerable towards you but you still want to continue your matrimonial life and want to live with her then you can always file a petition under section 9. And as far as the maintenance is concerned yesterday only a judgement was passed by the HC that if the woman is working and earning almost equal then she's not entitled to any maintenance. And if there's no scope of living together then rather than stretching the relationship you should go with mutual divorce because it's cost effective and ends up in a maximum of six months.
