Can we take a divorce before completing 1year of marriage

married on 18 th feb , husband wanted to give me divorce . Is this legal to give divorce before completing of 1 year of marriage

No, according to sec.14 Hindu Marriage Act, there should be one year separation period.

But if you both agreed and marriage was not a registered Marriage in your petition u/s 13 B HMA you both can show that marriage was solemnize before one year and since then you both were living separately..

Yes with the permission of the competent Family Court the divorce petition can be presented within one year of marriage if expectational circumstances exists for the parties.
If both parties agree to dissolve the marriage, the process to dissolve their marriage by appropriate decree of the competent court can be worked out within first year of the but for that you need to consult experienced and senior lawyer dealing divorce cases.

It is not easy to give divorce .law is very strict in this regard.your husband has to prove the ground very strictly before the court as well he has to pay maintenance u/s 24and this amount would be such that you could msintain the same ststus

No,its not possible to obtain decree of divorce before completion of 1 year,but various remedies are available better to talk.tkcr
